Additional Rules Governing Content Posted by Users on the Web Site
Member Content
As stated above, Comments submitted to the Website shall be owned by Kidz A La Mode. However, Kidz A La Mode does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, other works of authorship, or any other materials that you post to the Site (collectively, “Member Content”). After posting your Member Content to the Site, you continue to retain your ownership rights in such Member Content, and you continue to have the right to use your Member Content in any way you choose. The license you grant to Kidz A La Mode is non-exclusive (meaning you are free to license your Member Content to anyone else in addition to Kidz A La Mode), fully-paid and royalty-free (meaning that Kidz A La Mode is not required to pay you for the use of the Member Content that you post), sublicensable. The license does not grant to Kidz A La Mode the right to sell your Member Content.
You represent and warrant that: (i) you own the Member Content posted by you on or through the Site or otherwise have the right to grant the license set forth in this section, and (ii) the posting of your Member Content on or through the Site does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. Prohibited activity includes, but is not limited to the following: criminal activity, including, but not limited to, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, trademark infringement, copyright infringement, patent infringement, or theft of trade secrets; any automated use of the system, such as using scripts to add friends or send comments or messages; interfering with, disrupting, or creating an undue burden on the Web Site or the networks or services connected to the Site; attempting to impersonate another user of the Site, another member, or any other person; using the account, username, or password of another member at any time or disclosing your password to any third party or permitting any third party to access your account; selling or otherwise transferring your profile, without permission from Kidz A La Mode; using any information obtained from the Site in order to harass, abuse, or harm any person or entity; or displaying an advertisement on your profile, or accepting payment or anything of value from a third person or entity in exchange for your performing any commercial activity on or through the Site on behalf of that person or entity, such as placing commercial content on your profile, posting blogs or bulletins with a commercial purpose, or sending private messages with a commercial purpose.
Product Colors
We have made our best reasonable effort to display as accurately as possible the colors of the products shown on the Site. However, because the specific colors you see on the Site will depend on the resolution and color settings of your particular computer monitor and/or mobile device screen, we cannot guarantee that your monitor and/or mobile device screen display of any color shown on the Site will be accurate with respect to the actual color of one or more products displayed or depicted on the Site.
Correction of Errors & Inaccuracies
We endeavor to present the most recent, most accurate and most reliable information on the Site at all times. Typographical Errors
In the event a Kidz A La Mode catalog product is listed at an incorrect price due to typographical error or systems error, Kidz A La Mode shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Kidz A La Mode shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged.
Term & Termination
Terms are applicable to you upon your accessing the Site and/or completing the registration or shopping process. These Terms, or any of them, may be terminated by Kidz A La Mode without notice at any time for any reason. Provisions relating to Copyrights, Trademark, and Miscellaneous, shall survive any termination.

If you are purchasing Kidz A La Mode products with a credit card, you agree that, upon acceptance by Kidz A La Mode of your order, Kidz A La Mode may charge your credit card for the full cost of your order plus shipping. You further agree that risk of loss on products you order will shift to you upon Kidz A La Mode’s delivery of those products to a carrier at Kidz A La Mode’s distribution or fulfillment center, and that you will pay shipping costs from Kidz A La Mode’s distribution or fulfillment center to you. Also, you agree that you are of legal age in your country or you have consent from your parent or guardian to make the purchase.
You agree that you will not make sales of Kidz A La Mode items on Amazon, Poshmark, eBay, iOffer, Yahoo, auction sites, kiosks, swap meets, flea markets or discount stores. Kidz A La Mode products can only be offered on a website owned by the party submitting the order. You also agree not to use any logos, trademarks, and/or photographic images from the Site as they are subject to proprietary copyrights exclusively owned by Kidz A La Mode.
Payment terms can be granted by account or by order. Order submission confirms you agree to abide by your terms for payment on your order as it applies to payment due dates and payment method. Overdue accounts are subject to late payment charges of 1.5% per month, which is an annual percentage rate of 18%.
Damage requests must be made within 10 calendar days of merchandise receipt to be considered for replacement.
Cancellations must be made within 24 hours of order submission in writing or via email. Cancellations made after 24 hours will not be honored.
Returns will only be accepted as exchanges only with a return form 14 days from the receipt date. Refunds are not accepted. Returns sent without a return form will be refused. Bounced shipments will be subject to a 25% restocking fee of the total purchase amount including shipping.
Special Admonitions for International Use of the Web Site
Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and to provide only acceptable Member Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.

Severability
